Terms of Service (AGB)
§ 1 Scope
These General Terms and Conditions apply to the use of the online platform Hoply, operated by Hoply UG (haftungsbeschränkt) (hereinafter 'Provider'), by users (hereinafter 'Users'). Deviating conditions do not apply unless explicitly agreed to.
§ 2 Subject of Service
The Provider provides a free information platform where users can research sports events. The Provider owes no specific success, in particular no availability, execution, or quality of the displayed events.
§ 3 External Providers & Affiliate Links
(1) The platform contains links to external websites, in particular to ticket shops and organizers. (2) These external offers are not services of the Provider. (3) If a contract is concluded via such a link, it is exclusively between the user and the respective third-party provider. (4) The Provider assumes no liability for prices, availability, contract execution, cancellations, or refunds. (5) The Provider may receive a commission (affiliate compensation) for mediated clicks or purchases.
§ 4 Advertising
The platform may contain advertising content. This can be integrated automatically or manually. Advertising does not necessarily influence the editorial presentation of events.
§ 5 Registration
Use of the platform is generally possible without registration. If registration is optional, truthful information must be provided. Access data must be treated confidentially.
§ 6 Availability
The Provider strives for the most uninterrupted availability of the platform possible but cannot guarantee it. Maintenance, technical faults, or force majeure may lead to restrictions.
§ 7 Liability
(1) The Provider is liable without limitation for intent and gross negligence. (2) In cases of simple negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage. (3) Liability for damages resulting from injury to life, body, or health remains unaffected. (4) Liability for third-party content and services is excluded.
§ 8 Copyright
The content published on the platform is subject to German copyright law. Use outside the legal limits requires the prior consent of the rights holder.
§ 9 Online Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
